Acceptance of Terms

Welcome to ThinkMoney ("we", "our", "us"), operated by ThinkMoney Financial Services, accessible at thinkmoney.in. By accessing or using our website, chatbot (Theo), or any of our services, you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, please discontinue use of our services immediately. These Terms constitute a legally binding agreement between you and ThinkMoney.

Our Services

ThinkMoney is a financial product comparison and lead generation platform. We operate as a Direct Selling Agent (DSA) in partnership with Andromeda and Ruloans, and as an insurance referral partner with PolicyBazaar. Our services include:

• Comparison of loan products from banks and NBFCs (Home Loans, Personal Loans, Business Loans, Car Loans, Gold Loans, Education Loans, Loan Against Property, Used Car Loans, Balance Transfers, Two Wheeler Loans)
• Comparison of Fixed Deposit and Savings Account rates
• Insurance product information and referrals
• Investment guidance and referrals through SEBI Registered Investment Advisors
• AI-powered financial guidance through our chatbot "Theo"
• Connection of users with qualified human financial experts

Eligibility

To use our services, you must:

• Be at least 18 years of age
• Be a resident of India
• Have a valid mobile number registered in India
• Have legal capacity to enter into a binding contract under applicable Indian law
• Not be barred from using our services under any applicable law

By using our services, you represent and warrant that you meet all the above eligibility requirements.

Account Registration & OTP Verification

Access to certain features of ThinkMoney requires registration via your mobile number and email address. We use One-Time Password (OTP) verification to authenticate users. By registering, you agree to:

• Provide accurate, current, and complete information
• Receive OTP verification messages via WhatsApp, SMS, or email
• Not share your OTP with any third party
• Notify us immediately if you suspect unauthorised use of your account
• Accept responsibility for all activities that occur under your account

ThinkMoney will never ask you for your OTP via phone call or email from unsolicited sources. Protect your OTP at all times.

Financial Information Disclaimer

The financial information, rates, and product details displayed on ThinkMoney are provided for informational and comparison purposes only.

• No Guarantee of Loan Approval: Displaying a loan product does not constitute any guarantee or assurance of loan approval. All lending decisions rest solely with the respective bank or financial institution.
• Rate Accuracy: Interest rates, processing fees, and other financial details are subject to change. Verify current rates directly with the lender before making any financial decision.
• Not Financial Advice: Our AI chatbot Theo and our human experts provide general guidance only. Nothing on this platform constitutes personalised financial advice under SEBI or RBI regulations.
• No Liability for Decisions: ThinkMoney is not responsible for any financial decisions made based on information found on this platform.
• Third-Party Content: Information from third-party sources is provided as-is and we make no warranties regarding its accuracy or completeness.

User Conduct

When using ThinkMoney's services, you agree not to:

• Provide false, misleading, or inaccurate information in any enquiry or registration form
• Impersonate any person or entity, or falsely represent your affiliation
• Use the platform for any unlawful purpose or in violation of applicable laws
• Attempt to gain unauthorised access to any part of the platform or its systems
• Transmit any viruses, malware, or other harmful computer code
• Use automated tools (bots, scrapers) to collect data from the platform without permission
• Submit multiple fraudulent enquiries to manipulate our services

We reserve the right to suspend or terminate your access immediately for any violation of these conduct standards.

Data Collection & Privacy

By using ThinkMoney, you consent to the collection and use of your personal information as described in our Privacy Policy. Key points:

• Information Collected: Name, mobile number, email, pincode, loan requirements, employment type, and details you provide in enquiry forms
• Purpose: To match you with appropriate financial products and connect you with our DSA partners and lending institutions
• Sharing: Your information may be shared with our DSA partners (Andromeda, Ruloans), lending institutions, and insurance partners solely to fulfil your enquiry
• Communications: You consent to receiving calls, SMS, WhatsApp messages, and emails from ThinkMoney and our partners regarding your enquiry
• Opt-out: Request deletion of your data or opt out of communications by contacting pancham@thinkmoney.in

We comply with India's Information Technology Act, 2000 and applicable data protection regulations. We do not sell your personal data to unrelated third parties.

WhatsApp & Messaging Communications

ThinkMoney uses WhatsApp Business API to communicate with users, including sending OTP verification codes and transactional messages. By providing your mobile number, you consent to:

• Receiving OTP and verification messages via WhatsApp
• Receiving transactional updates related to your enquiries
• Interacting with our AI chatbot Theo via WhatsApp
• Receiving follow-up communications from our expert team

Messages are sent from our registered WhatsApp Business number (+91 72082 10339). You may opt out of non-transactional messages by sending "STOP" to our WhatsApp number.

Intellectual Property

All content on thinkmoney.in — including text, graphics, logos, the ThinkMoney brand, the "Theo" AI chatbot concept, website design, and code — is the intellectual property of ThinkMoney or its licensors and is protected under applicable Indian intellectual property laws.

• You may not reproduce, distribute, or create derivative works without prior written permission
• You may not use our brand name, logo, or trademarks without express authorisation
• Scraping, data mining, or automated collection of our content is strictly prohibited
• Personal, non-commercial use (reading, sharing links) is permitted

Limitation of Liability

To the fullest extent permitted by applicable law, ThinkMoney shall not be liable for:

• Any direct, indirect, incidental, special, or consequential damages from use of the platform
• Loss of data, revenue, profits, or business opportunities
• Decisions made by lending institutions including loan rejection or unfavourable terms
• Accuracy of information provided by third-party banks and financial institutions
• Technical interruptions, errors, or downtime of the platform
• Any financial loss arising from reliance on information provided by Theo

Our total aggregate liability in any circumstances shall not exceed ₹5,000 (Indian Rupees Five Thousand Only).

Indemnification

You agree to indemnify, defend, and hold harmless ThinkMoney, its officers, directors, employees, agents, DSA partners, and affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with:

• Your violation of these Terms
• Your misuse of the platform or any of its services
• Provision of false or misleading information by you
• Violation of any applicable laws or regulations by you
• Infringement of any third-party rights by you

Termination

ThinkMoney reserves the right to suspend or terminate your access to the platform, without notice, for any reason including violation of these Terms, fraudulent or illegal activity, or conduct that harms other users or our operations.

You may terminate your relationship with ThinkMoney at any time by ceasing to use the platform and requesting deletion of your data. Termination does not affect any rights or obligations that arose prior to termination.

Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall first be attempted to be resolved through good-faith negotiations. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.

These Terms are subject to the Indian Contract Act, 1872; the Information Technology Act, 2000; the Consumer Protection Act, 2019; and other applicable Indian laws.

Changes to These Terms

ThinkMoney reserves the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date, notify registered users via email or WhatsApp where practicable, and post a notice on our website for at least 7 days.

Your continued use of the platform after any changes constitutes your acceptance of the modified Terms.
